SPOTLIGHT REPORT ~ Fathers and Families, Inc. Files Suit Against Massachusetts’ Judges
Fathers and Families, Inc. along with 10 other Plaintiffs have filed suit against Massachusetts’ Chief Justice Robert Mulligan and all judges that might use the newly court ordered Child Support Guidelines. The Complaint from Fathers and Families, Inc., seen below, requests Declaratory Temporary Injunctive Relief (Memorandum on Temporary Relief) and Permanent Injunctive Relief against the judges in the State of Massachusetts.
Attorney Gregory Hession, attorney for Plaintiffs provided a Spotlight Report on March 16, 2009 to open the discussion on the critical issues. The Complaint alleges violation of Equal Protection, Violation of Due Process, Violation of Massachusetts Declaration of Rights Article XXX, and provides a long introduction on where he believes the Chief Justice went wrong in “unilaterally implementing the new child support guidelines.” Among other points, the “secretly” discussed guidelines, as stated by Hession, subject some of the Plaintiffs to a double and triple increase in child support without any finding of a change in circumstances.

This an amazing story, that a Judge can make a change to the law unilaterally with respect to guideline child support without due regard to the constitution and other law-making / legislature procedures and public consultation and parliamentary debate and passing.
This would not happen in Australia. We have what we call the “separation of powers” between the Parliament and the Judiciary.
This Grand Scale Racketeering 101 – tantamount to fraud and corruption.
To think that this happens in the United States of America is breathtaking. I thought it was the land of the free. This is the sort of thing that happens in fascist or communist states.
I hope CJ Mulligan is jailed for life for his hand in this and the Court is injuncted to use these guidelines.

This is very interesting story, i go on feb 3rd to see what my visitation is going to be, and what my child support will be for my one daugther, i dont mind paying money for my daughter, but i dont want any of it going to her mother, because she has wanted money through all this, my daughter has minimal expenses, cuz my Ex’s parents are millionares and pay for everything, they actually live with them, so they dotn pay anything for rent, food, cloths, diapers, NOTHING….it will be interesting how much the judge makes me pay, i am a teacher and dotn make much

the court is run like a fast food drive thru where quantity not quality matters-i feel for the fathers working legitimate “on the book” jobs, who find themselves paying through the nose and fathers (and mothers) who can manage to parent in a way that embodies the sentiment of “the best interest of the child(ren)” but as a single mom of three that has a controlling ex-husband that at one time owed thousands until I ignorantly made the mistake of state assistance while he owned his own business and put assests in his current wife’s name,- buying the children expensive toys and provided expensive outings, but the girls have to bring clothes and toiletries on visits because he refuses to buy them basics or promote structured (showers,weekend homework) he even made them sleep on the livingroom floor in front of the very big screen t.v. because it was not “fun”
to provide a bedroom with a bed. So maybe instead of working on the “figures” of the guidelines-work on mandatory disclosure-and penalties for perjury, and maybe a more intensive parenting after divorce program with a “reality” segment where maybe parents on both ends could realize that children have needs that do come with a price tag and in their best interest they should have everything that both parents can provide.
